FEBRUARY 23--Despite reports that a wild melee early Sunday at a Denny’s in Massachusetts was triggered by a dispute over maple syrup, a police report indicates that the combatants had earlier been involved in road rage incidents while en route to the eatery from a Chicopee sports bar.

Video of the brawl, which has gone viral, can be seen below.

According to a Chicopee Police Department report, the male and female brawlers (whose names were redacted from the document) had departed the Maximum Capacity bar when their respective cars were involved in several vehicular confrontations.

The fighters, as it turned out, were all headed to the chain restaurant. “Both vehicles arrived at Denny’s at the same time and words were exchanged in the parking lot,” cops noted.

Inside, it wasn’t long before punches began flying. A Denny’s manager told investigators “that he observed an argument outside between the aforementioned parties.”

While investigators have identified each pugilist seen in the YouTube video, a Chicopee Police spokesperson said that for someone to be charged with simple assault and battery the attack must occur in the presence of a police officer.

But the brawlers--who yesterday were each provided a copy of the police report--have the ability to go to court and seek a criminal complaint against their assailant. (1 page)

Someone punches somebody..it's on video..no charges? Read that as Chicopee PD too lazy to get off their lard azzes to do anything. Bad behavior is bad behavior. Ethnicity or gender has nothing to do with anything. The bad behavior should be addressed. I was appalled that the behavior was allowed to continue without them being kicked out of the restaurant or the police called to address the altercation while it was in progress. I feel for the other patrons that had to sit through the "Jersey Shore" type behavior.
It's ok to be scared but I'd rather take a beating while swinging than walking out with my tail between my legs like this guy did. If the guy has a weapon then run if you can but if no weapon and one-on-one and you get popped... start swinging. If I were there I'd almost want to help the victim of the beating but I'd get involved and then he'd walk and it would be my fight. Walk softly and carry a big stick. In other words, keep your mouth shut, avoid trouble but if it comes defend yourself or go through like a B

If you can read -- the police report says hispanic male. If not, take my word for it. By the way, how in the world could you tell the race of the attackers from that video? Everyone one in view of the camera was white -- Some of you people need some serious help --it's not a black and white thing. One a#$hole cut off another a@#hole. So the aggressive woman moved too close to the other car, then the other car got ahead of her and made several abrupt stops. One car pulls into the Dennys parking lot, so the other one followed. The aggressive woman who made the first wrong move on the highway and her big male friend continued by confronting them in a restaurant with other people nearby, which could have then cause bodily harm to nearby people. Both were wrong on the highway, but the aggressive woman and big guy were wrong to continue this in a restaurant.

It's comforting to know that you can be sitting in a booth at Denny's and some idiot (regardless of the words that are being exchanged) can rush you and start swinging like a coward bitch, and there's no legal recourse. I don't care about the fight. What I want to know is: Was there, or was there not, enough maple syrup? Failure to provide sufficient pancake syrup at a pancake restaurant should be a crime.
The police spokesman is right about simple A&B requiring officer presence, or a court complaint. However, what we have here is not simple A&B. At one point in the video, the woman in the light blue jacket appears to kick the other woman. That would be Assault & Battery with a Dangerous Weapon, to wit: a shod foot. That's a felony.
While our young people are out at Denny's at 2am on a Tuesday night. Vijay Singh and Ho Chee Chow are at home studying for exams. While we're all concerned about Muslim extremists China and India are quietly taking over. We're all doomed if we don't wake up. Nevermind it's already too late.
I couldn't agree with you more, Mr. Positive; as a college instructor, I see more evidence of this every semester. As for the geniuses in this video, I can't imagine any of them making it too far in life past the stripper pole or a job in the fast food industry.

I agree. I teach at a community college. But it's hard to blame these kids when they manage to graduate high school and not be able to write even a small paragraph, even a simple sentence. They've learned exactly what the system expected of them: next to nothing. I have a friend who teaches high school. Every time he fails a student he has "justify" it in writing, fill out all kinds of forms. Fail too many and the principal sits you down for a meeting. The message is clear, don't fail students. I do fail as necessary and never have to explain it, but by that point, at community college, it's too late for many. Not all, but many. The point is, you can't blame the idiots when society encourages them to be so. I have a lot of students who don't want the life they're heading toward and do not have the skills to avoid it.
I taught at a local college also, and I agree...if I failed a student, it was up to me "to do whatever I can to help him/her pass". It wasn't "what could the student do", which of course I would give them every opportunity to hand in "extra credit work" to make up for all the work they didn't do all semester long. And when they still didn't do it, it was up to ME to "do what I can" to help them pass. I stood up for my principles and guess what...I'm no longer teaching.

There are not many good teachers left in the system. There are still some, but for the most part the ones that are left are the ones that are playing the game according to the system's and the students' rules. Sad but true.
Harassment needs to be in presence of an officer not assault/battery. What you have here are complainants who refuse to press charges on one another. Unless it is domestic there is NO "Must arrest" requirement.
It's not the specific violation that determines arrest, it's whether or not the violation is a misdemeanor or a felony. If the violation is a felony, then there MUST be an arrest by an officer. If the violation is a misdemeanor, and the officer is not present during the violation, the citizen can choose to make the arrest and if he/she does, the officer MUST take the offender into custody for further processing. If a misdemeanor is committed in the presence of an officer, the officer CAN take the offender into custody, or can choose to do a "cite and release" depending on the specific violation or severity of the situation.
Question: How come everytime I see a violent incident or stupid 911 call it always involves blacks? Is someone just trying to make blacks look stupid and violent? Why would someone treat a brother like that? Trying to start some kind of race conflict? Just saying!

A misdeanor which is what that was had to be in the presence of a police officer. Burglaries, bank robberies and murder are felonies. Get it?
You need some education, it seems. In MA, assault and battery is apparently a misdemeanor, not a felony. In the US, misdemeanors MUST be committed in the presence of a police officer for there to be an arrest by the officer. Felonies, like burglaries, bank robberies, and murder don't have to be committed in the presence of officers for an arrest to be effected. For misdemeanors not committed in the presence of an officer, the victim makes a citizen arrest and the officer takes the offender into custody for further adjudication in the system.
I'm sure I'm in need some education, and I'm not disagreeing, but I was thinking of incidents like those in this story http://tinyurl.com/65ch8um and I've seen a lot more like it. There could be other extenuating circumstances that lead to the arrests. At the very least some of the men at Denny's should have stepped in. Even if they were intimidated by the fat guy swinging his fists, they should have stepped in to restrain the woman.
Doesn't Denny's have any options here? I suppose they would not pursue any if they did, preferring to drop the whole thing, but I would think a fight, on video, in their restaurant would allow them to file some type of charges.

Your an idiot, go read some laws first. If those people want to charge then they can. Its a misdemeanor not a felony and they aren't related so it isnt domestic violence (the only way they can be charged by someone other than the victim). IF there was an Officer in the restaurant at the time this happened then, yes, they COULD have been arrested, but even then it is that Officer's discretion to arrest or simply give them a ticket for disorderly conduct and assault.
How do you know it is a misdemeanor? Punching someone in the head 10 times may well be a felony. Do you know if the victims teeth were knocked out or his nose broke? That would be a felony here in Texas These weren't just light shoves. The degree of force and extent of injury matter. Do you think if they beat them to bloody pulps it would still be a misdemeanor? Obviously not. It's a matter of degree. The assaults look like felonies to me. You may want to read up on "some laws" too friend.
The victims can go and file a complaint in court. The defendants would then be summoned in or if the Judge so desired he could issue warrants for thier arrest.
