Swinger Sergeant Charged

SEPTEMBER 21--An HIV-positive Air Force sergeant had sex with at least 11 individuals without informing them of his medical condition or using condoms, according to charges filed late yesterday against the noncommissioned officer.

As first reported by TSG, Sergeant David Gutierrez, 43, met a “multitude” of sex partners at “swinger” parties and through adult web sites. Gutierrez, stationed at McConnell Air Force Base in Wichita, is a 20-year Air Force veteran who has been in military custody since early last month.

Gutierrez was charged yesterday with a variety of counts, including aggravated assault, indecent acts, obstructing justice, and adultery. He was also accused in a charge sheet, a copy of which you’ll find here, of violating a specific October 2009 order directing him to advise sexual partners of his HIV status. Gutierrez’s wife told investigators that he became infected with HIV while stationed in Italy in 2007, and that upon returning to the U.S. in 2008, he "began having unprotected sex with numerous partners."

Air Force officials have redacted the names of the 10 women and one man from the Wichita area with whom Gutierrez is alleged to have had sex without disclosing his HIV status. Investigators are continuing to probe Gutierrez and have asked anyone who may have had sexual contact with him to contact Sedgwick County Health Department officials.

When TSG disclosed the investigation into Gutierrez on August 26, a search warrant application listed the names of only two women identified as victims. It appears that the additional victims surfaced in the wake of press coverage of the Air Force probe.

An Article 32 hearing, which Air Force officials liken to a civilian grand jury, is scheduled for October 5 at McConnell Air Force Base. If a determination that sufficient evidence exists against Gutierrez, his case will be referred to a court martial proceeding. (4 pages)

I have known several homosexuals(while I was an active drug addict)(I am clean 10 years now) that KNEW they had full blown A.I.D.S. and did ALL they could to infect as many people, both gay and straight with their disease. When I asked them as to WHY they told me that they were angry with the world and thought that if more people were infected that we would focus on developing a cure faster? This is still shocking to me. Yet ANOTHERT Gay aquaintance once knowingly loaded a syringe with heroin(He and a woman had gone half on a bag of dope)using HIS dirty HIV infected Syringe AFTER he had used his Dope, he loaded her half of the dope into HIS syringe without bothering to tell her. She, fortunately KNEW he was infected so she didn't fall for it but she whipped his butt so badly I imagine he is STILL feeling that one. I am POSITIVE that this sort of occurance happens ALL the time. We are just way too Politically Correct to address it and God forbid we actually Offend anyone with that bad 'old truth that seems to really bother so many people. I am sure that I am going to be called all sorts of things for telling these 100%true stories, that is fine with me, I Always try to be truthful, that used to be a very important thing in our society. It isn't popular any longer due to the Idiotic Political non-sense we are ALL forced to endure, especially under the current "leadership"
Everyone is still missing the big picture, here! Yes, the guy was a jerk for doing what he did. Sounds to me like he wanted to take out as many people as he could and make them suffer, but the bottom line is, each and every one of those people he was with were ADULTS!! Last time I checked, it was their own responsibility to ask for him to wear a condom! It's their own fault!
He should be charged with attempted murder.
@ Molasses, it says he contracted HIV while serving in Italy. There is a Air Force base out there. So he was already in the Air Force when he contracted it. There are a number of protocols someone would have to go through if they became infected while being in the USAF.

If someone has HIV they can't get into the armed forces, so how can this man, who has violated so many laws and who has brought this disease down on himself still be allowed to be in the armed forces? This makes no sense at all.

I ask you to delete it so there is no connection between the two. You think there is only one "David Gutierrez serving in the military over the past twenty years? THINK BEFORE YOU POST!
I Googled his name and "IF" it is the same 'Sergeant David Gutierrez', he showed-up in the Honolulu Star Advertiser Posted on: May 24, 2004, about half-way down the page, but it says Army, not Air-force. Shown with "wife Patricia, and sons Andrew, 6, and Jeremiah, 5 months, came to Hawai‘i in October 2001. I think that may be a different David Gutierrez. In the first TSG article about this, his wife is listed as "Gina".
