Jury Convicts Duo For Florida Beach Sex Romp

Beach Sex Conviction

MAY 5--A jury yesterday found a Florida couple guilty of having sex on a beach in front of numerous tourists, a conviction that requires them to register as sex offenders and will likely result in a lengthy prison term for the male half of the randy duo.

After deliberating only 15 minutes, the panel convicted Elissa Alvarez, 20, and Jose Caballero, 40, of two counts of lewd and lascivious behavior in connection with the sandy romp last July on Bradenton Beach.

Following the verdict, Alvarez and Caballero (pictured above) were taken into custody in advance of sentencing on the felony counts.

Since Alvarez has no prior arrests, she faces significantly less time than Caballero, a convicted felon who spent about eight years in prison for cocaine trafficking. Since he was arrested on a felony charge less than three years after his 2013 release from custody, Caballero is facing a maximum 15-year sentence for the lewd and lascivious behavior charges.

In late-March, Alvarez’s lawyer filed a severance motion arguing that “the unsavory taint” of Caballero’s extensive criminal record would “negatively impact” his client. That motion, however, was denied by a Circuit Court judge.

At trial, several witnesses testified to watching Alvarez (left) and Caballero having sex on the beach. Additionally, jurors viewed video shot by a onlooker showing Alvarez grinding atop Caballero, who was lying on a sheet.

As detailed in a probable cause affidavit, witness Emily Hall told cops that Alvarez and Caballero initially began fondling each other and “then started to have intercourse on the beach.” Hall said that she was “very upset because her 4 year old daughter witnessed the couple having sex.” An investigator noted that six other beachgoers filled out complaint affidavits describing the illicit tryst.
