But Judge Elden Fox, who is presiding over the actress's Los Angeles Superior Court trial, declined a prosecution request to admit into evidence the confession. After Ryder's lawyer rested the defense case, Fox today (11/4) unsealed the transcript of an October 24 hearing regarding a variety of pre-trial issues, including the admissibility of certain evidence. During that hearing, prosecutor Ann Rundle detailed several statements Ryder allegedly made after being stopped in the Beverly Hills store last December. During the October hearing, Ryder's attorney, Mark Geragos, claimed that male security guards "in excess of 250 pounds" threatened and "sexually abused, if you will" his client while Ryder was being held in a small Saks office. As he would later claim in his October 28 opening argument, Geragos stated during the pre-trial hearing that the actress's shirt was lifted during a search. At that point during the closed-door hearing, Ryder added, "And my skirt." Geragos continued, "And her skirt was lifted up in front of the males who were there."
