New York prosecutors today (12/5) asked a judge to vacate the convictions of five men found guilty of the vicious 1989 rape and beating of a female jogger in Central Park. Citing a flawed prosecution and new evidence that trumped confessions made by the teenage suspects, Manhattan District Attorney Robert Morgenthau filed the below motion in State Supreme Court. The jogger case was reopened earlier this year when another man, Matias Reyes, confessed to the attack--and DNA linked Reyes to the rape of the 29-year-old investment banker. The five defendants have all completed prison sentences--ranging from 7-1/2 to 13-1/2 years--imposed following their convictions on crimes ranging from attempted murder to assault. Morgenthau's recommendation was filed with Judge Charles Tejada, who has said he will rule on overturning the convictions by February. (58 pages)
