Police Reports Detail Alleged Spacey Assault

Actor faces felony for sex encounter with teen

Kevin Spacey Case

DECEMBER 27--The sexual assault case against Kevin Spacey is detailed in graphic Massachusetts police reports that accuse the actor of plying an 18-year-old bus boy with alcohol in a Nantucket restaurant and then repeatedly jamming his hands in the teen’s pants and groping the victim’s genitals.

Spacey, 59, has been charged with indecent assault and battery in connection with the July 2016 incident at The Club Car restaurant. He is scheduled for a January 7 arraignment on the felony count, which carries a maximum five-year prison term.

The criminal complaint against Spacey--filed December 20 in Nantucket District Court--includes a series of State Police reports memorializing interviews with the victim, his girlfriend, his sister, and several restaurant workers. The accuser, who did not contact cops immediately after his encounter with Spacey, was first interviewed by State Police investigators in November 2017.

A Spacey lawyer contends that the sexual encounter between the actor and the teenager was consensual and not criminal.

The accuser, now 20, told police that he was introduced to Spacey by the bar’s doorman and that the performer proceeded to buy him a series of drinks. After the teen consumed four or five beers, Spacey allegedly said they should switch to whiskey. “Let’s get drunk,” the teen quoted Spacey saying. The teen, who said that he told Spacey he was 23,  added that “he and Spacey had 4 to 5 glasses of whiskey,” according to a police report.

Spacey and the teen subsequently moved from a table to the bar’s piano area, where they “were doing sing-alongs and Spacey had his arm around” the accuser. At one point, Spacey asked the bus boy “what he was packing.” After the teen, who was wearing shorts and a button-down shirt, said that he was “average,” Spacey allegedly replied that “his dick was 8 inches long.”

The teen told cops that when he went outside to smoke a cigarette with Spacey, the actor asked if he wanted to “go back to his house with his friends.” The request “seemed weird,” the teen told police, “based on Spacey’s earlier comments about his dick.” The teen said he saw Spacey’s comment as a “red flag” and “seemed like a come-on.” The accuser, cops noted, “thought Kevin Spacey was gay and trying to get him back to his house.”

When they returned to the crowded bar’s piano, Spacey, standing behind the teen, allegedly began rubbing the accuser’s thigh and then “worked his way up to [the teen’s] zipper.” Saying that Spacey’s advances “happened quickly,” the teen told police that the actor “unzipped his pants” and placed his hand on the teen’s penis in a “sexual manner.” The accuser “described Spacey to be rubbing his dick.”

The teen, who estimated that Spacey touched him for three minutes, said that the actor was “trying to jack him off” and “kept reaching down his pants” as the teen tried to shift his body away. The accuser said that he did not know what to do when Spacey began touching him, saying that he “didn’t want to get in trouble at work or get his work in trouble.” The bus boy, an investigator noted, “knows he’s only 18, he’s not supposed to be drinking, and he’s not supposed to be drinking at his work.”

While allegedly being molested by Spacey, the teen said he was “texting and snapchatting” with his girlfriend Molly Doyle. At one point, the alleged victim sent Doyle, 21, a Snapchat video of Spacey touching him. The clip reportedly shows Spacey touching the front of the teen’s pants “by his crotch,” according to a police interview with Doyle.

Police have a copy of the Snapchat video the teen sent to Doyle. 

The accuser told police that when the actor went to use the bathroom, he told a female patron that Spacey was "trying to rape him.” He then left the bar and ran home. While en route to his residence, the teen said he received a text from Spacey, who wrote, “I think we lost each other.”

The teen’s sister told police that when he returned home that night, he said, “Kevin Spacey just raped me.” Describing her brother as “flustered,” she added that he recounted that the actor put his hand “in his pants.”

Doyle said the accuser had sent her a text reporting that “Spacey was hitting on him,” and that she advised her boyfriend “to walk away.” Doyle said she later spoke with the teen when he got home, describing the accuser as “emotionally worked up” and repeating that, “I’m not gay.” Doyle told police that the victim was “caught off guard a man would hit on him.” 

The alleged victim is the son of Heather Unruh, a former Boston TV news anchor. During a press conference last November, Unruh accused Spacey of assaulting her son, adding that police were investigating the matter.

Spacey has been repeatedly accused of making unwanted sexual advances to men (some of whom have claimed that they were minors at the time). The allegations have derailed the career of the Oscar-winning actor, who last year was dropped by his agent and publicist and fired from the Netflix show “House of Cards.”

In response to allegations by actor Anthony Rapp that Spacey made sexual advances to him when he was 14, Spacey said that he while could not recall their encounter, “if I did behave then as he describes, I owe him the sincerest apology for what would have been deeply inappropriate drunken behavior, and I am sorry for the feelings he describes having carried with him all these years.”

Before dropping Spacey as a client, his spokesperson claimed that the actor was “taking the time necessary to seek evaluation and treatment. No other information is available at this time.” (10 pages)
